Terms and Conditions for Ticket “Buyers”

Welcome to MyRacingCalendar. MyRacingCalendar enables sport event organisers in Malta to plan, promote, and sell tickets for sporting events.

The following pages contain our Terms of Service, which govern all use of our Services.

This page refers to the terms and conditions on which tickets are supplied to Buyers from the MyRacingCalendar website www.myracingcalendar.com (“Site”). Please read these terms and conditions carefully. By signing up and using the Site, a Buyer confirms acceptance of these terms.

Ticket Terms and Conditions 

1. By using the Site, you (“You”) expressly agree to be bound by the following "Terms and Conditions" and all applicable laws and regulations governing our Services.
2. Our Services are fully owned and operated by KMC (P-2165) of 5, Triq Hughes Hallet, Sliema SLM3143. 
3. We reserve the right to change these Terms at any time, effective immediately upon posting on the Site and any other channels of communication. Visitors should check this page for any changes to the Terms and Conditions. Visitors shall be bound by the Terms and Conditions in effect from time to time.
4. Should you violate these Terms, MyRacingCalendar may terminate your use of our Services and bar you from future use of such Services. This may even result in ticket cancellation. This without prejudice to any futher legal action.
5. You represent that you are over the age of 16. MyRacingCalendar does not permit those under 16 to use the Service.
6. By using our Site, you are also accepting the Privacy Policy of MyRacingCalendar. 
7. The price of a ticket is quoted on MyRacingCalendar, which price is set by the Event Organiser. The price includes value added tax, if applicable.
8. Event tickets are sent to you through electronic mail at the email address provided.
9. You should check your tickets upon purchase for any mistakes. Mistakes cannot always be rectified.
10. Not all tickets sold for an event are necessarily sold through MyRacingCalendar. An Event Organiser may sell tickets via other means such as physical tickets or digital tickets. 
11. Unless otherwise stated by an Event Organiser, tickets cannot be exchanged or refunded or cancelled after purchase.
12. MyRacingCalendar charges a booking fee per ticket, that is payable with the ticket payment. The booking fee is non-refundable even if a ticket refund is given.
13. Event tickets are issued subject to the rules and regulations of the Event Organiser. By completing a purchase, you are confirming that you have read any specific terms and conditions which the Event Organiser has issued with regard to this Event.
14. It is your responsibility to review the terms and conditions of the Event including any medical requirements and sporting requirements, before acquiring a ticket. Tickets will not be refunded if you do not qualify to participate in the Event. 
15. In acquiring a ticket, you declare and undertake to abide by all applicable eligibility rules and competition rules. 
16. MyRacingCalendar is solely a provider of ticketing services. MyRacingCalendar is not responsible in whatsoever manner for the Event. MyRacingCalender is not responsible for the actions or failures of any Event Organiser. Under no circumstances shall we be liable for death or personal injury suffered by you or your guests (or your property) arising out of an Event. 
17. MyRacingCalendar is not responsible for the organisation or staging of the Event and has no control over the cancellation or rescheduling of or for material changes to any Event.
18. Should the event be cancelled, postponed or unsatisfactory, or should the Buyer not be allowed or able to attend the event for any reason, MyRacingCalendar shall not be held responsible for any liability including any costs whatsoever incurred by the Buyer. Any such claims or disputes are to be directed towards and are the responsibility of the Event Organiser.
19. Any change in relation to an Event will be communicated through the Site. The Buyer should access the Site for notice of any change in the Event. It is the Event Organiser’s responsibility to communicate any such change to the Site.
20. MyRacingCalendar is a booking platform and is not authorised to issue refunds. It is the responsibility of the Event Organiser to communicate its refund policy to Buyers. If a Buyer desires a refund, the Buyer must request from the Event Organiser. Refunds are to be handled directly between the Event Organiser and the Buyer. You acknowledge that MyRacingCalendar is a booking platform and is not authorised to issue refunds unless instructed to do so and paid for by the Event Organiser. The booking fee of MyRacingCalendar shall not be refundable.
21. MyRacingCalendar excludes to the fullest extent allowed by law any liability for loss, damages, expenses or any other claim whether in contract, tort or otherwise arising out of or in connection with this agreement or the purchase of tickets made through the Site. MyRacingCalendar disclaims all and any liability for all acts, omissions and conduct of third party advertisers, sponsors and Event Organisers on the Site in connection with the sale of tickets, with the Event or otherwise related to the use of the Site. With prejudice to the foregoing, MyRacingCalendar’s maximum liability arising in connection with the terms and conditions of the purchase of tickets shall be of the booking fee paid on the ticket.
22. Buyers must ensure that information provided by them is correct and kept updated. It is the responsibility of the Buyer to inform MyRacingCalendar of any change in personal details of the Buyer. MyRacingCalendar is not responsible for any incorrect information provided by the Buyer.
23. Communications with the Buyer will be through electronic mail or by posting notices on the Site. The Buyer agrees to be notified in such manner.
24. MyRacingCalendar shall not be liable for any failure to perform, or delay in performance of, any of MyRacingCalendar’s obligations that are caused by events outside of its control (force majeure events), fortuitous events, or events caused by third parties including by the Event Organisers.
25. Our Service may contain links to third-party web sites or services that are not owned or controlled by the MyRacingCalendar. It is your responsibility to review the relative terms and conditions and privacy policy of any such third parties. 
26. MyRacingCalendar provides no warranty or undertaking, and makes no representation of any kind that the Service will meet your requirements, achieve any intended results, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
27. In the event of any inconsistency with the terms of the Event Organiser, the Terms and Conditions of MyRacingCalendar shall prevail.
28. These terms and conditions are subject to the laws of Malta and the jurisdiction of the courts of Malta.

Terms and Conditions for Event Organisers

Welcome to MyRacingCalendar. MyRacingCalendar enables sport event organisers in Malta to plan, promote, and sell tickets for sporting events.

This page refers to the terms and conditions for Event Organisers to promote and sell tickets for Events on the MyRacingCalendar website www.myracingcalendar.com (“Site”). Please read these terms and conditions carefully. By signing up and using the Site, an Event Organiser confirms acceptance of these terms.

Event Organiser Terms and Conditions

1. By using the Site, you (“You”) expressly agree to be bound by the following "Terms and Conditions" and all applicable laws and regulations governing our Services.

7. It is your responsibility as the Event Organiser, when promoting and selling tickets to an Event, to provide all relative specific terms and conditions for the Event including any sporting and medical eligibility criteria.
8. It is your responsibility to check that the Event information provided including any terms and conditions, are correct and up-to-date. You shall be responsible for the Event as uploaded to the Site. Should there be any mistakes, you should inform us as soon as possible.
9. MyRacingCalendar charges a booking fee per ticket, that is payable with the ticket payment. The booking fee is non-refundable even if a ticket refund is given.
10. You shall honour all tickets sold through MyRacingCalendar. 
11. MyRacingCalendar is solely a provider of ticketing services. MyRacingCalendar is not responsible in whatsoever manner for the Event. MyRacingCalender is not responsible for the actions or failures of any Event Organiser. Under no circumstances shall we be liable for death or personal injury suffered by you or your guests (or your property) arising out of an Event. Such responsibility lies with the Event Organiser.
12. MyRacingCalendar is not responsible for the organisation or staging of the Event and has no control over the cancellation or rescheduling of or for material changes to any Event. Such responsibility lies with the Event Organiser.
13. In listing an Event on the Site, you guarantee and warranty that you have the necessary resources to deliver on the said Event and guarantee that you will deliver the Event as promoted on the Site. 
14. Should the event be cancelled, postponed or unsatisfactory, or should the Buyer not be allowed or able to attend the event for any reason, MyRacingCalendar shall not be held responsible for any liability including any costs whatsoever incurred by the Buyer. Any such claims or disputes are to be directed towards and are the responsibility of the Event Organiser.
15. Should there be any changes in relation to an Event, it is your responsibility to communicate such a change to the Site.
16. Should you postpone, cancel or otherwise fail in providing the Event as promoted, you are solely and fully responsible for such failure including for any losses and damages incurred. MyRacingCalendar shall not refund its booking fee to ticket purchasers; therefore you undertake to refund such booking fee – if such claim is justified – to the buyers. 
17. MyRacingCalendar is a booking platform and is not authorised to issue refunds, or to handle exchanges, refunds or cancellations. It is the responsibility of the Event Organiser to communicate its refund policy to Buyers. If a Buyer desires a refund, the Buyer must request from the Event Organiser. Refunds are to be handled directly between the Event Organiser and the Buyer. You acknowledge that MyRacingCalendar is a booking platform and is not authorised to issue refunds unless instructed to do so and paid for by the Event Organiser. The booking fee of MyRacingCalendar shall not be refundable.
18. 19. MyRacingCalendar shall not be liable for any failure to perform, or delay in performance of, any of MyRacingCalendar’s obligations that are caused by events outside of its control (force majeure events), fortuitous events, or events caused by third parties including by the ticket purchasers.
20. Our Service may contain links to third-party web sites or services that are not owned or controlled by the MyRacingCalendar. It is your responsibility to review the relative terms and conditions and privacy policy of any such third parties. 
21. MyRacingCalendar provides no warranty or undertaking, and makes no representation of any kind that the Service will meet tour requirements, achieve any intended results, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
22. When a person buys ticket to your Event, the relative personal data of the purchaser shall be passed on to you. You are the Data Controller of the data for the purposes of this Event. It is your responsibility to comply with your data protection obligations in relation to the processing of this data. You undertake to only use such data for the purposes of contacting you in relation to the Event, such as advising of any postponement, cancellation, news and updates regarding the Event.
23. In the event of any inconsistency with the terms of the Event Organiser, the Terms and Conditions of MyRacingCalendar shall prevail.
24. These terms and conditions are subject to the laws of Malta and the jurisdiction of the courts of Malta.
